Terms of Service
The short version. FitEntrepreneur is free during the beta and for people aged 16 and over. The coach is an AI: it gives general training guidance, not medical advice. Your content stays yours and private. Don't use the service for illegal or harmful things; if we ever restrict something, we tell you why and how to challenge it.
1. Who we are
FitEntrepreneur is provided by Konstantin Apostolov, [business address, the Netherlands], the Netherlands, KvK [KvK number] ("we"). How to contact us: see section 11.
2. Who can use it
You must be 16 or older. The service is free during the beta. We may introduce paid plans later, but we will never charge you without your explicit agreement.
3. What the service is, and what it is not
- FitEntrepreneur gives general strength-training guidance, workout tracking and an AI coach.
- Full use of the AI coach needs a free Google sign-in. Without signing in you can try the app as a guest: take the assessment and get one plan, log workouts, ask the coach 3 questions per browser tab and get AI feedback on up to 30 sets a day. The AI writes guest plans and answers while the allowance all guests share lasts (30 plans and 50 questions an hour). After that a guest's plan is our standard plan, built from the same answers, and the coach asks guests to sign in.
- The AI coach is an AI system, not a person. Its answers can be wrong, incomplete or unsuitable for you.
- FitEntrepreneur is not a medical service. It does not diagnose, treat or prevent any disease.
- Talk to a doctor before starting intense training if you have a medical condition or an injury, are pregnant, or are unsure. Stop training and get medical help if you feel pain, dizziness, chest pain or shortness of breath.
- FitEntrepreneur is independent and is not affiliated with, endorsed or sponsored by Mike Mentzer or his estate.
4. Your content
You keep all rights to what you enter: workouts, notes and messages. You allow us to store and process it only to provide the service to you, as described in the Privacy Notice. Your content is private: other users can't see it.
5. Rules and content moderation
Don't use the service to store or send illegal content, to harass or threaten anyone, to attack or overload the service (including automated scraping), or to try to make the AI produce harmful content. To keep the service safe, we use these tools:
- (a) Automated input checks. Messages longer than 5,000 characters, or containing code-like patterns used in attacks, are rejected before we store them. You see the reason straight away.
- (b) Rate limits and monthly AI credit. You can ask the AI coach (questions and plans) at most 6 times per minute, 40 times per hour and 60 times per day, across all your chats. AI feedback on logged sets and workout summaries is limited to 30 per minute, 100 per hour and 200 per day; past that you see your logged numbers without the AI line. Each signed-in account also has a monthly AI credit that starts again on the 1st of every month (Amsterdam time); the coach page shows what is left once half of it is used. When 80% of it is used, the coach answers with a smaller, faster AI model and keeps its answers shorter. When it is used up, the coach chat pauses until the 1st, new plans are the standard plan and logged sets show your numbers without the AI line; logging workouts, your history and your progress keep working. You can download your data and send content reports up to 5 times per hour each. You see a notice when you reach a limit.
- (c) AI safety filters. An automated classifier screens messages to and from the AI coach for self-harm, medical and dangerous content, and changes how the coach responds, for example by sharing help resources. It doesn't remove your stored content.
- (d) Human review. The founder personally reviews every report (section 6) and every restriction of an account. We never suspend an account by automated means alone.
6. Reporting illegal content
Anyone can report content they believe is illegal using our report form. Your report should include why the content is illegal, where it is (a link or ID), your name and email (not needed for reports of child sexual abuse material), and a statement that your report is accurate and complete to the best of your knowledge. We confirm receipt, decide carefully and objectively, and tell you our decision and how you can challenge it.
7. When we restrict content or accounts
We may remove content, or suspend or end an account or access to the AI coach, if content is illegal or breaks these terms. Unless the law prevents us, we tell you why: the facts, the rule concerned, whether automated tools were involved, and how to challenge the decision. You find these statements in Account & privacy.
Repeated abuse includes repeatedly submitting manifestly illegal content and repeatedly sending manifestly unfounded reports. For repeated abuse we warn you first. After that we may suspend the account, or stop handling your reports, for 7 to 30 days, or permanently in serious cases. We take into account how often it happened, what share of your activity it was, how serious it was, and whether it seemed intentional.
8. Challenging a decision
Reply to our decision, or write to legal@fitentrepreneur.nl, within 6 months. A person will review it, and if you are right we will reverse the decision without delay. You can always go to court.
9. Ending your account
You can delete your account at any time in Account & privacy. That permanently erases your data. We may stop the service with 30 days' notice, and will let you download your data first.
10. Liability
Nothing in these terms limits liability that the law does not allow us to limit, including liability for death or personal injury caused by our negligence and liability under product liability law. Beyond that, and as far as the law allows, we are not liable for indirect or consequential damage arising from the free beta.
11. Contact points
- Users (DSA Art. 12): support@fitentrepreneur.nl or the report form.
- Member State authorities, the European Commission and the European Board for Digital Services (DSA Art. 11): legal@fitentrepreneur.nl.
- We communicate in English and Dutch. A person answers every message.
12. Changes
We tell you about significant changes in the app at least 30 days before they apply. If you don't agree, you can delete your account before then.
13. Law and courts
Dutch law applies. If you are a consumer living in another EU country, you keep the protection of that country's mandatory law, and you can go to court there.
